1. Agreement
These terms govern use of the websites, customer portal, and courier services of SMS Courier Limited (“SMS Courier”, “we”, “us”). By creating an account, booking a shipment, submitting an inbound transfer, or using tracking on this site, you agree to these terms and our Privacy policy.
If you book on behalf of a company, you confirm you are authorised to bind that company.
2. Who we are
SMS Courier Limited operates from No. 300 Oron Road, Uyo, Akwa Ibom State. Contact: info@smscourier.ng, +234 7063244142.
3. Services
Depending on your account, we may provide:
- Pickup, warehouse handling, and last-mile delivery of parcels.
- Public and portal tracking, status updates, and proof of delivery.
- Company catalogue, inbound transfers to our hubs, and fulfilment from accepted hub stock.
- Staff tools for store, driver, and admin operations.
Coverage, transit times, and rates are as quoted at booking or in a separate commercial agreement. Published website prices are guides and may change.
4. Accounts
You must provide accurate details and keep your password confidential. You are responsible for activity under your account. We may suspend or close an account that is used fraudulently, abusively, or in breach of these terms.
5. Bookings, addresses, and contents
You must give complete pickup and delivery addresses, recipient contacts, and a fair description of the goods. You warrant that you are entitled to send the items and that they are packed to withstand normal courier handling.
We may refuse, hold, or return a shipment that is unsafe, illegal, misdeclared, inadequately packed, or outside our network.
6. Prohibited items
You must not tender, among other things: illegal drugs, explosives, firearms and ammunition, hazardous chemicals that we have not agreed in writing to carry, perishable goods unless we have agreed, cash or negotiable instruments of high value unless agreed, or anything prohibited by Nigerian law or by carriers we use.
7. Pickup, delivery, and proof
Transit estimates are not guarantees. Delivery is to the stated address. We may capture a photo, signature, timestamp, and location as proof of delivery. That record is evidence of completion unless you promptly show a clear error.
If the recipient is unavailable we may retry, hold at a hub, or return the parcel as our operations team decides. Extra attempts or returns may incur charges.
8. Hub stock
Company inbound transfers are credited as hub stock only after SMS Courier counts and accepts the goods. Quantity accepted may be less than quantity sent if there is shortage or damage. Customer shipments from a hub are fulfilled only from accepted available stock.
9. Charges and payment
Fees are those shown at booking or in your contract. You remain liable for unpaid charges, including customs, storage, or return costs caused by incomplete documents or refused delivery. We may withhold goods until outstanding sums are paid, where the law allows.
10. Liability
We take reasonable care of parcels in our possession. We are not liable for delay caused by incorrect addresses, weather, traffic, force majeure, or the recipient’s unavailability. Liability for loss or damage is limited to the lower of the declared value you provided at booking, the repair or replacement cost of the goods, or ₦50,000 per shipment, unless a signed written agreement states a higher limit or you purchased declared-value cover we offered.
We are not liable for indirect or consequential loss, including lost profits or business interruption. Nothing in these terms excludes liability that Nigerian law does not allow us to exclude, including for death or personal injury caused by our negligence, or for fraud.
Claims for loss or damage must be notified in writing to info@smscourier.ng within 14 days of the delivery date or the date the shipment should have been delivered.
11. Website use
Do not misuse the site: no scraping that harms the service, no attempts to access other customers’ data, and no interference with tracking, payments, or staff tools. Public tracking is for checking a number you have been given; it is not a directory of all shipments.
12. Changes
We may update these terms. The “Last updated” date will change. Material changes apply to bookings made after the new date. Continued use of the site after an update means you accept the revised terms.
13. Governing law
These terms are governed by the laws of the Federal Republic of Nigeria. The courts of Nigeria have exclusive jurisdiction, without prejudice to any mandatory consumer protections that apply to you.
